These Terms of Service govern your access to and use of the DME Holsters website and any purchase made through the website. By accessing the website, creating an account, submitting an order, or using the website’s services, you agree to these Terms of Service.
About DME Holsters
DME Holsters is a woman-owned custom holster manufacturer located in Marana, Arizona. References to “DME Holsters,” “we,” “us,” or “our” include DME Holsters LLC and the DMEHolsters.com website.
Eligibility and Lawful Use
You may use this website and purchase products only when legally permitted to do so.
You are responsible for complying with all applicable federal, state, local, and other laws concerning the purchase, possession, transportation, and use of any product ordered through this website.
DME Holsters may refuse or cancel an order when we reasonably believe that completing the transaction would violate applicable law, create a safety concern, involve suspected fraud, or violate these Terms of Service.
Product Configurations and Order Information
Many DME Holsters products are manufactured for a specific firearm, accessory, handedness, carry style, and combination of selected options.
You are responsible for reviewing and accurately completing all order fields before submitting an order, including:
- Firearm manufacturer, model, variation, and barrel length
- Light or laser manufacturer and model
- Handedness
- Carry style
- Optic, threaded-barrel, compensator, retention, and other selected options
- Billing, shipping, telephone, and email information
Similar firearm or accessory names do not necessarily indicate that the products have identical dimensions or will fit the same holster.
DME Holsters is not responsible for fit problems resulting from inaccurate, incomplete, or incorrectly selected order information. Fit concerns are reviewed under the DME Holsters Warranty and Guaranteed Fit Policy.
Order Acceptance
Submitting an order does not guarantee that DME Holsters will accept or manufacture the order.
An order may be placed on hold, declined, or canceled because of:
- Incorrect or incomplete order information
- An unsupported firearm or accessory configuration
- Pricing or website errors
- Payment authorization problems
- Suspected fraudulent activity
- Material or component availability
- Legal or shipping restrictions
If DME Holsters cannot complete an accepted order, any payment collected for the unfulfilled portion of the order will be refunded.
Pricing and Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Applicable shipping charges, taxes, and other disclosed costs are shown during checkout. You authorize DME Holsters and its payment providers to charge the payment method submitted with your order.
DME Holsters may correct pricing, description, or configuration errors before accepting or manufacturing an order. We will contact you when a correction materially affects the product or amount charged.
Manufacturing and Estimated Lead Times
DME Holsters manufactures products to order. Current estimated lead times are displayed on the website or provided during the ordering process.
Lead times are estimates rather than guaranteed delivery dates. Manufacturing time may be affected by order volume, configuration complexity, material availability, equipment issues, or the need to develop and test new tooling.
If DME Holsters cannot ship within the time represented when the order was placed, we will provide any notice, cancellation opportunity, or refund required by applicable law.
The FTC requires online sellers to have a reasonable basis for an advertised shipping period and, when that period cannot be met, to obtain consent to the delay or provide a refund for the unshipped merchandise.
Shipping and Delivery
Orders are shipped to the shipping address submitted during checkout. Customers are responsible for confirming that the address is complete and accurate before submitting the order.
DME Holsters is not responsible for delays or delivery problems caused by:
- An incorrect or incomplete address
- Carrier delays
- Weather or transportation interruptions
- Delivery restrictions
- A customer’s failure to retrieve or accept a package
Contact DME Holsters promptly if tracking shows an unexpected delivery problem.
Available shipping methods, destinations, and charges may change and are displayed during checkout.
Order Changes and Cancellations
Contact DME Holsters as soon as possible when requesting an order change or cancellation.
Changes are not guaranteed after materials have been ordered, tooling has been developed, or manufacturing has begun. Additional charges may apply when an approved change requires additional materials, components, tooling, or labor.
Cancellation requests are reviewed under the DME Holsters Refund & Return Policy.
Returns and Refunds
Return eligibility depends on the product and how it was configured.
Standard returns, custom-product returns, cancellation requests, return shipping, restocking amounts, and refund processing are governed by the separate DME Holsters Refund & Return Policy.
Do not return a product without first contacting DME Holsters and receiving return instructions.
Warranty and Guaranteed Fit
DME Holsters provides a limited lifetime warranty covering eligible defects in materials and workmanship.
Fit concerns, exclusions, repair or replacement options, claim procedures, and the Guaranteed Fit Policy are governed by the separate DME Holsters Warranty page.
Warranty coverage is nontransferable and applies to the original purchaser.
Product Safety and User Responsibility
Products must be used responsibly, lawfully, and only with compatible equipment.
The customer is responsible for confirming compatibility, inspecting the product regularly, following the applicable manufacturers’ instructions, and discontinuing use if a product becomes damaged, altered, loose, worn, or unsuitable for its intended configuration.
Do not modify, heat, drill, cut, reshape, or otherwise alter a product when requesting warranty or fit assistance unless DME Holsters has specifically authorized the modification.
DME Holsters products should not be stored or exposed to temperatures exceeding 180°F.
No product or website information is a substitute for appropriate training, safe handling practices, or compliance with applicable law.
Website Information
DME Holsters attempts to keep product descriptions, compatibility information, prices, photographs, and other website content accurate.
However, website content may occasionally contain errors or become outdated. Product appearance may vary slightly because of monitor settings, material batches, manufacturing changes, or the custom nature of the product.
DME Holsters may correct errors and update website content without prior notice.
Intellectual Property
The DME Holsters name, logo, website design, photographs, text, graphics, product descriptions, CAD-related content, and other original website materials are owned by or licensed to DME Holsters unless otherwise stated.
Website content may not be copied, republished, distributed, sold, or used commercially without prior written permission from DME Holsters.
Customer Submissions
When you submit photographs, reviews, comments, measurements, configuration information, or other material to DME Holsters, you confirm that you have the right to provide that material.
Submitting information for customer support, warranty review, order fulfillment, or a return request authorizes DME Holsters to use the information as reasonably necessary to evaluate and respond to the request.
DME Holsters will not publicly use customer-submitted photographs or testimonials for advertising without appropriate permission.
Third-Party Services
The website may use third-party companies for payment processing, website hosting, analytics, email delivery, fraud prevention, shipping, security, and other business services.
DME Holsters is not responsible for the independent websites, availability, or practices of third-party services, although we select and use service providers as part of operating the website and fulfilling orders.
Privacy
Collection and use of personal information are governed by the separate DME Holsters Privacy Policy.
Payment-card transactions are processed by third-party payment processors. DME Holsters does not store customers’ payment-card numbers, expiration dates, or security codes on its website.
Disclaimer of Website Warranties
To the fullest extent permitted by applicable law, the website and its content are provided on an “as available” basis.
DME Holsters does not guarantee that the website will always be uninterrupted, error-free, secure, or free from technical problems.
Nothing in this section limits the separate written product warranty or any rights that cannot lawfully be waived.
Limitation of Liability
To the fullest extent permitted by applicable law, DME Holsters will not be liable for indirect, incidental, special, punitive, or consequential damages arising from access to or inability to use the website.
Any limitation of liability concerning a physical product is subject to applicable law and the written DME Holsters Warranty.
Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to every customer.
Governing Law
These Terms of Service are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction’s mandatory consumer protections control.
Any legal venue provision should be interpreted only to the extent permitted by applicable law.
Arizona recognizes that electronic contracts and records cannot be denied legal effect merely because they are electronic.
Severability
If any provision of these Terms of Service is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
Changes to These Terms
DME Holsters may revise these Terms of Service as business practices, website features, or legal requirements change.
The current version will be posted on this page with an updated revision date. Changes apply to website use and transactions occurring after the revised terms are posted, unless applicable law requires otherwise.
